Welcome to AUSPOS – a unified inventory, POS, and eCommerce software suite designed for Australian businesses. By accessing or using our cloud software / SaaS, services, or website (www.auspos.net.au), you agree to the following Terms and Conditions. If you do not agree, you must not use our services.


 

1. Definitions

  • AUSPOS, We, Us, Our: Refers to the company that owns and operates the AUSPOS software platform.

  • You, Your, User, Licensee: Refers to the individual, business, or entity using AUSPOS.

  • Software: Refers to the AUSPOS applications and modules, including POS, inventory, ecommerce, CRM, and integrations.

  • Services: Includes access, support, implementation, training, and system management provided by AUSPOS.


 

2. Eligibility

You must be a registered business or authorized representative of a business to use AUSPOS. Individuals under 18 years of age are not permitted to register or use our services.


 

3. License and Access

We grant you a non-transferable, non-exclusive, revocable license to use AUSPOS in accordance with your subscription. You may not:

  • Reverse-engineer, decompile, or replicate our software

  • Share your license with third parties

  • Use the software for illegal or unauthorised purposes

We retain full ownership of the AUSPOS software and intellectual property.


 

4. Account Responsibility

You are responsible for:

  • All activity under your account

  • Securing your login credentials

  • Ensuring accurate business information

We are not liable for unauthorised access resulting from your negligence.


 

5. Fees and Payments

Our pricing includes:

  • One-time setup and onboarding fees

  • Monthly or annual license fees (may vary by user count or GMV)

  • Optional add-ons and integrations

All fees are non-refundable unless stated otherwise in writing. We reserve the right to change pricing with notice.


 

6. Third-Party Integrations

AUSPOS integrates with third-party services such as:

  • Payment gateways (PayPal-Braintree, Stripe, Australian banks)

  • Cloud services (AWS, Microsoft)

  • APIs (Google Maps, Geo APIs, Twilio)

These integrations belong to and are controlled by the customer. AUSPOS does not store or manage their credentials or take responsibility for their performance, security, or policies.

We disclaim any liability arising from:

  • API outages or failures

  • Transaction errors

  • Data breaches or limitations of those third-party services


 

7. Data Ownership and Privacy

  • You retain ownership of your data (orders, inventory, customer records, etc.)

  • We collect and use data as outlined in our Privacy Policy

  • Data is securely stored on our cloud infrastructure (AWS, Microsoft)


 

8. Uptime and Availability

We aim to provide 99.9% uptime but cannot guarantee uninterrupted access due to:

  • Third-party API outages

  • Internet issues

  • Scheduled maintenance

  • Natural events beyond our control

We disclaim liability for any damages arising from service interruptions.


 

9. Support and Updates

  • Basic onboarding and limited-time free support are included in initial plans

  • Additional support and training may incur fees

  • We provide regular software updates and improvements

We are not liable for compatibility issues arising from third-party systems or outdated browsers/devices.


 

10. Termination

You or AUSPOS may terminate the agreement at any time with notice. Upon termination:

  • Your license is revoked

  • Access to AUSPOS will be disabled

  • You may request a data export (fees may apply)

We reserve the right to suspend or terminate accounts for:

  • Breach of these terms

  • Fraud or misuse

  • Non-payment


 

11. Limitation of Liability

To the maximum extent permitted by law:

  • AUSPOS is not liable for any indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption

  • We are not responsible for errors, delays, or failures of third-party systems

  • Your use of AUSPOS is at your own risk


 

12. Intellectual Property

All software, branding, content, and documentation remain the exclusive property of AUSPOS. You may not use our trademarks, logos, or content without prior written consent.


 

13. Modifications

We may update these Terms from time to time. Updates will be posted on our website and take effect immediately. Continued use constitutes acceptance of the revised Terms.


 

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled by the courts of NSW.
